U.S. Senate Majority Leader Harry Reid is circulating a LETTER to Rod Blagojevich that effectively voids the Illinois governor’s authority to appoint anyone to Barack Obama’s seat.

He really screwed up, BIG TIME.
He’s reduced himself to nothing less that losing complete respect from anyone and everyone, everywhere.
He’s made himself a “punchline”, dare I say, and will spend the rest of his life under the shadow of his recent poor decisions.
He’ll still get appointed to a job by someone who’s palm he had padded while in office (likely in Cook county), as will his wife, and they’ll still make more individually than most of us make as a combined household income (per year) after he serves out some minuscule (microscopic) “hand slap” sentence in some white-collar facility.
The only lesson that he learned is what to do better, next time, so that he doesn’t get caught.
People (mostly wishers) want to see him behind bars ala George Ryan, but, it won’t happen that way. He’ll wriggle out of it.
I think, however, that he’s likely buried his political career, though……………………

I wonder what case law exists that good old Harry is relying on to make the threat in his letter. My guess, given Harry’s track record, absolutely none.
BTW-Jesse Jackson Jr. has confirmed that he is potential appointee (or whatever the designation was) #5. That would be the candidate whose “associates” were willing to pony up a cool million for the appointment. Much like his famous father, I am sure Jr. could extort far more than that in his first term.
You can’t pay enough for this kind of entertainment.

I guess it is in how you read Article I, Section 5, but if the Governor’s appointee meets the criteria to be a Senator, it would take 2/3 of the Senate voting to expel them. If anyone has a better legal explanation, I’d like to hear it.

Snuss-He would be relying on the ability of each house to determine the qualifications of its members language or the threat of expulsion. In either case I suspect that good old Harry is issuing an empty threat which would not withstand Constitutional scrutiny (qualifications) or practicality (expulsion).
Of course, Constitutional scholar Harry could be relying on penumbras and emanations. Who knows?
