 If someone with an infallible crystal ball had told you a year ago that the first Supreme Court nomination by the next president would prompt members of the opposition party to cry racism, you probably would have figured that Republicans would win the White House in the November election.
 But, of course, it turned out that a Democrat won the presidency. Hence, extraordinary as it may seem, it’s the Republicans — or some of them, anyway – who are making accusations of racism in connection with a high court nomination.
 But there are other Republicans who cringe at the spectacle of their party mates playing the race card in this matter.

 On June 3, 2008, Barack and Michelle Obama made a gesture that triggered apoplectic seizures among the pseudo-patriots at Fox News, one of whom wondered aloud if this curious ritual was a “terrorist fist bump.”
 In celebration of the first anniversary of this wonderful event, next Wednesday has been designated National Fist Bump Day. Check out the details HERE.

 It’s an article of faith among right-wingers that judges should not “make law.”
 But Supreme Court Justice Antonin Scalia, a favorite among conservatives, takes a different view.
 In a 2002 case, Scalia wrote this:
This complete separation of the judiciary from the enterprise of “representative government” might have some truth in those countries where judges neither make law themselves nor set aside the laws enacted by the legislature. It is not a true picture of the American system. Not only do state-court judges possess the power to ”make” common law, but they have the immense power to shape the States’ constitutions as well.

Of all the falsehoods and fabrications about Sonia Sotomayor that have arisen this week, THESE are the most popular.
 UPDATE: A new Gallup Poll SHOWS that 47 percent of Americans see President Obama’s choice of Sotomayor as good or excellent, while 33 percent think it’s fair or poor. Twenty percent have no opinion.

 There’s a theory going around among conservative bloggers to the effect that the Chrysler dealerships targeted for closing tend to be those whose owners lean to the Republican side of the political spectrum.

 E.J. Dionne says Sonia Sotomayor “is the most conservative choice that President Obama could have made” to fill a vacancy on the Supreme Court.
 ”It is highly unlikely that she will push the court to the left,” writes Dionne. “Indeed, on many issues of concern to business, she is likely to make the Chamber of Commerce perfectly happy.”
