Prorok TV ad is on the air

January 15th, 2008 at 01:17am Chuck Sweeny

The big Republican race for Winnebago County state’s attorney got a second TV commercial today — at least that’s the first time I’ve seen it. Chuck Prorok, former chief deputy state’s attorney to former S.A. Paul Logli, has an impressive TV’er that shows him looking very official — at one point, he lifts a crime-scene tape and walks into the scene of SOMETHING IMPORTANT, I’m sure.

The ad says that Prorok is running because experience and independence count.

Prorok is running against appointed S.A. Phil Nicolosi, who’s ad has been running for awhile.

However, if you check with the campaign rules listed with the State Board of Elections, you will find that Chuck Prorok’s ad violates the rules? Shouldn’t he be penalized for running an ad that violates the rules? Also, doesn’t he have people working on his campaign to make sure that rules as such aren’t violated?

How does the Prorok commercial violate the rules?

How does Chuck’s ad violate the rules?
Also, aren’t Nicolosi’s comments about all the experience he has misleading? He has never prosecuted a felony case. The State’s Attorney office prosecutes felonies like rape, homicide etc. Doesn’t experience in these areas matter? I think it does. I haven’t made up my mind yet, but I dislike misleading advertisements.

Prorok’s ads violate the rules in that their is a courtroom in the ads. You can check the election code and the Supreme Court Rules and other statutes and regulations.

As for Nicolosi’s being misleading he has done everything that he states he has done. If I recall correctly Paul Logli didn’t have any felony experience when he entered the State’s Attorneys office 21 years ago and he didn’t have felony trial experience until approximately his last year in office which would be after serving 20 years as the Winnebago County State’s Attorney.

This was not an attack on Chuck Prorok however there are certain rules for political campaigns and they should be followed. Both candidates bring forth positive qualities for a State’s Attorney. However, the State’s Attorney rarely if ever prosecutes a case him/herself in larger counties. Their job is to run the office in a effective manner which requires more then felony trial experience.

I saw the ad. I actually spoke to my students, who were taking a course from me on Crime Scenes a the Palatine Polica Department. The question asked related to prosecutors crossing crime scenes. Even an inexperienced prosecutor should know that it is foolish to cross a crime scene. Mr. Sweeney, as much as I respect your opinion, I think this was a very poor ad. It is a well known fact amount law enforcement officers that a prosecutor SHOULD NEVER enter a Crime Scene. He could unwittingly touch something and contaminate it and he places himself in the position of being a witness. This was a very poor ad. So, Chuck Prorock further convinced me that he should not be State’s Attorney if he does not know the basics of crime scenes.

Unfortunately Daniel Gilbert does not know what he’s talking about. He sounds like a lawyer, but he’s obviously not a prosecutor. There is nothing wrong with a prosecutor’s going into a crime scene. The Cook County SAO has a whole unit of attorneys who do nothing other than go to crime scenes and advise the police. The issue here is that you can’t be a witness and personally prosecute the same case. Daniel Gilbert should check his facts before he makes such bold statements.
